I declare to You my intention to make the impeachment of
Scalfaro Oscar Luigi for violation of Italian Constitution
and violation of Human Rights as in art. F of MAASTRICHT
Treaty.

The violation of Human Rights are made against Italians in
general but specially against me because of an appeal I
proposed in 1996 that never had course. These facts deeply
involve the European Community's Institutions because I
paid violations of Human Rights also in European Parliament
and European Commission.

The facts here described are full of obligation for
European Community and European Commission, especially You
must propose an European action for Italy which must tend
to reinforce democracy and law, under the "Subsidiary
Principle" of treaties.

In any case any further legitimacy given to the actuals
false Parliament and false Government of Italy will be in
violation of statement 2 art.F of MAASTRICHT Treaty and
consequently illegitimate.

Below the facts.

I wrote to You the March 28, 1997 (I repeat, March 1997)
talking about Civil, Political and Human Rights Violation
in Italy. In summer 1997 I asked to know the name of a
correspondent in the European Commission administration:
never I had an answer. When I say "asked" I mean that I
have a document to prove it.

So, to verify situation in European Commission, I write to
You also this year 1998, asking help for Italy because
Mafia (somebody say "political" Mafia) is at hight level in
Italian institution: during 1996 and 1997 I wrote to the
known Presidents of two chambers of Parliament, to the
President of Constitutional Court, to the President of
Republic, Prodi as President of Government, Military Chefs
etc,etc.

I believe that a kind of Fascist Mafia have subverted the
Italian State, and when I say Fascist I intend "not
democratic groups" as was Italian Fascism and Russian
Communism, just to do some example.

Last summer, still without any answer from the European
Commission (neither about an appeal about illegal TV-spots
in Italy - still they are made), as a final defense against
"omerta'" (conspiracy of silence) I sent 200.000 e-mail to
European posting the question if Mafia is the real
government of Europe. Nothing changed.

Not enough, when in august I wrote to 500 news agency about
the illegal attempt to arrest me inside the tribunal where
they negate me Human Rights, bombs start to appear all
around Italy, surly not for my cause, I'm totally leave
alone. I said they are criminals of the Mafia, that's a
kind of Fascism, in my opinion they are ready to use bombs
if they risk to loose the real government control.

Mr. Santer, some weeks ago You was in Venice, only 30 Km
from me, and there You said "We want to protect Human
Rights". I believe it. But last week You said also "Prodi
can be a good successor for Presidency of Commission". No,
at the contrary, Prodi has made a Golpe and a Human Rights
Violations against me and Italians as in art.3 of First
Protocol of THE EUROPEAN CONVENTION ON HUMAN RIGHTS (I will
call it the "Convention"), protected by Art.F of Maastricth
Treaty. Prodi made it in 1996 and the proves are in
Internet. Even that I wrote to You.

Clearly Your sentences demonstrate You are prevent from
Mafia to receive the information about Italy, I have to
suppose You are in a kind of imprisonment: this situation
totally justify me to send this letter publicly also to
thousands of citizens and politicians all around Europe.
What I'm doing with this message is to exercise one between
the Human Rights of the conventions, and after that we
Europeans will be sure You know all about Italian Mafia.

A lot of rights protected by the Convention are not granted
to me, so here a minimal and precise briefing about my
recent history.

In 1996 I was prevent from candidate myself in the national
elections. The elections was also falsed because made under
conditions which not ensured the free expression of the
opinion of the people in the choice of the legislature -
for example a lot of person was elected with signature
obtained with trick. Also informations was totally
controlled against law. The 1996 Italian election was
against art.3 Prot.I of the "Convention": for that reason
giving legitimacy to people that actually claim to be
rappresentative of Italian it's a violations of Human
Rights itself because they was elected against law, I say
they never was elected.

In 1996 unfortunately my oddissey was just only began (May
1996). I reported those facts to the local tribunal in
Padua, and also to President of Republic (Scalfaro Oscar) and
the self styled two Presidents of Parliament. The digital
copy of this documents are in Internet and they proved my
affirmations. It's a really visited sites also if the
documents are in Italian. Anyway I send a big part of these
document to You in 1997, by the Internet and by the postal
service.

Mafia in Padua censored these facts and Human persecution
against me, and all was keep in silence against law and
Constitutions. This was the violation of Article 13 of
Convention that's ".. an effective remedy before a national
authority". But recognize my persecution mean recognize the
illegality of the entire nationals elections of 1996
because I was one between others, not as now I am rested alone.

Meantime, what was doing the President Scalfaro? His
inactivity in defense of Human Rights force me to denounce
that He was not free of act as You was until now, kept in a
kind of imprisonment by this subversive power (this Mafia)
that control Italy. Finally in September 1997 I declared
the loosing of charge of Scalfaro (without claiming any
fault for Him) it was just an obligation to be done by the
internal law. It was necessary also to prevent legitimacy
of "Padania" Republic proclamation. I acted in name of
Italians and in defense of Human Rights in a defined legal
form of popular delegation ("azione popolare") protect by
Constitution. This give me a penal accusation. Actually no
more existed the "Padania" peril, but in 1997 the General
Prosecutor of Veneto declared it was a real risk. Anyway,
nobody can now indicate "Padania" as a menace for nation
integrity, I said that looking at "Convention" clauses.

My human persecution from the point of view of Convention.
As a person accused of a crime, I have asked many times to
be processed, I have asked a "legal assistance" because I
haven't "means to pay for legal assistance", but I didn't
have any legal assistance also if I am totally poor.
Anyway, as a person "charged with a criminal offence" I
have ask to tribunal to obtain the attendance and
examination of witnesses, between theme Scalfaro Oscar
Luigi. I was accused to have deligitimate the institutions,
but Scalfaro can confirm if He knew the facts I denounced,
and I think it's better deligitimate an Institution than
have Mafia in its place. In the determination of this
criminal charge against me, I have asked fair and public
hearing, and more than a reasonable time is expired. I have
asked a Judgment pronounced publicly in a impartial
tribunal established by law. Nothing of that all was
granted to me against Art.6 of the Convention, also against
a lot of articles in Italian Constitution, all this rights
are protected there. From years I'm asking justice without
result. On the contrary, the Judgment to get me out of my
home will run the December, 1, 1998, few weeks after the
appeal of the landlady was made, and that it's a too much
short time for a real defense, they said me 30 October.

All that I'm saying is not new about false elections, must
not be new also to Scalfaro Oscar, because in 1996 I made
an appeal to Presidents of Republic to squash elections of
1996 (and 1994 also): I never had an answer as a person
as I am, but below I explain how I'm sure He know.

I have ever thought Scalfaro was a kind a prisoner of Mafia
until the beginning of September 1998 when I received a
document from Secretary of Presidency of Republic: there
they talk about a Scalfaro's decision He took in 1997
against the appeal of a user's party I was the secretary of
until 1997.

I made an appeal also as a single human person, it was
clearly specified in the appeal my human person
qualification. This is not a legal excuse, it mean
different rights, I was prevent to candidate, Italia
Concreta also, but I was not candidate with Italia
Concreta. Moreover, this phantom decision Scalfaro took by
Scalfaro was never published in the "Gazzetta Ufficiale" (the
newspaper of law) and never I had the notification so that
to oppose. Before that, nobody of people that was involved
in the appeal was informed, Italian population was not
informed, it was the decision of "silence". Anyway, I'm not
an "entity", I'm a person that made an appeal as a
single person, so the decision it's not about my appeal. So
where is my rigth of appeal and the answer from an
impartial Judge? I never had an answer about my personal
appeal, again, this is against Convention but also against
Italian Constitution.

I must admit that, in effect, I was a little stupid,
because to admit my legal reasons would mean admit the
Scalfaro's violence against Constitutions, especially
article 1,2,3 of Constitution: I was stupid to wait for
Justice from who make violation of Constitution. What
Scalfaro made it was a violation made during the false
elections of 1996, I was writing to Scalfaro all the time
in those period. That personal interest in the appeal make
Scalfaro not a impartial Judge: unfortunately not other
legal way is actually given in the internal rigth, only an
external action of Community can resolve this legal
cul-de-sac.

When I understood my mis-understantment last September (but
it was due to my believing in the honesty of people) I
would made as soon as possible the impeachment of Scalfaro,
but there was the Kossovo problem: as a responsible person
I have suspended my rights for a while. Also there was too
much bombs around Italy, too much army around to made this
action.

Now the moment is better, Kossovo no more is an high risk
of war, also NATO is there, and Iraq is far enough. In
Italy no more bombs seem to be in place against politicians
and false politicians (if You will see any give
responsibilities to false the Government and friends), but
the impeachment of Scalfaro it's equally a so big problem
that only an European Action can resolve. Stated that also
the 2 false President of Parliament and any false
Government will get to impeachment because they receive
news about illegal election during 1996, stated that
Parliament are illegal and Constitutional Court is full o
people putted there by Scalfaro, the result is that nobody
can Judge Scalfaro for violation of Constitution as
president, but the population, only the population would.
By Italian Constitution, the sovereign is the population, but
behind the Juridical statement I remember the last judgment
made by this sovereign (Italians, I mean) it was against
Mussolini. I believe is ideally better an European
Community action that reinforce democracy and law.

I'm sure D'Alema didn't mentioned any problem of Italy
during the last meeting in Austria, that's clear because He
was not legally elected to the Parliament and recently He
tried to modify the Italian Constitution against it's
obligatory procedure, as Berlusconi want do now with a
constituency. D'Alema is not the President of a legal
Government, with Berlusconi He want modify electoral law to
keep in silence any opposition after a Coup d'Etat, they
make as a judge that modify the law during a process
against himself.

Mr, Santer, I give You all legitimacy necessary to make an
European Action for Italy under the subsidiary principles
of Maastricth Treaty, I give You it by the legal form of
"azione popolare", it make me a legal rappresentative of
Italians. If You believe this is not valid, You must
denounce it to Government, so that I will get to Prison.

Soon I will deposit the impeachment for Scalfaro Oscar,
Mancino Nicola, Violante Luciano and some others (in
effects this same letter is an impeachment) but if European
Action will not be in execution the day of deposition,
Italy will enter in a Institutional empty of powers, a kind
of juridical death. I defend democracy and human rights,
it's the law I found (luckily), so those day I will not
certainly feel responsible for a loose against this
Fascism, I will not feel responsible for the empty of
powers it will take place, It will better than Fascism

Now You know these facts together to a lot of people. I
pray You to act in defense Human Rights as Maastricth
Treaty says and as You talked in Venice. By my part, I feel
good in conscience because, even if here I omitted a lot of
other abuses I suffered, I feel to have tried anything in a
democratic fashion: I don't have spasm to obtain "power".
Instead, even I'm preparing to get to prison, I believe it
will necessary to fight this Mafia. Partisans died during
the first Italian Fascism to give me the liberty I found in
Italy when I born. I think I must fight this second one
until it is at beginning (it starting slow as the first
one). In effect, I'm in a condition similar of a Jew
during Italian Fascism just before they was deported.
I hope also You will not have fear of this allied
criminals. I believe You will not have fear because I'm sure
that You, as a Catholic, You will respect the Pope's appeal
for Human Rights.
